Living Will
Unlike a traditional will, a living will does not dispose of assets and property. It is an instrument that tells your doctor or medical caregiver that you do not wish to be kept alive by artificial means. It is a good idea to keep the original with your medical records. A health care directive is a similar instrument that designates an individual to make medical decisions on your behalf.
Will
A will disposes of your assets and property, as designated by you, after your death. It can designate who gets what and under what terms and conditions. You can disinherit individuals if you choose. Some people insert a "no contest" clause, which says that anyone who contests their gift under the instrument, their gift will be revoked. The will has to go through probate and may be supervised by the court.
Living Trust
A trust is an instrument that you create while alive. A revocable trust can be amended or altered, as opposed to an irrevocable trust. The creator of the trust (trustee) often receives the income from the trust while alive. Upon death, the income from the trust can continue for the benefit of someone you choose.
