The Probate System

If you have been named as the executor or personal administrator in someone's will, you will need to go through probate court. The purpose is to pay any taxes and expenses of the deceased, and then distribute assets as designated in the will. We will draft the numerous documents to submit to the court and prove up the will before the judge.

Once you have been appointed executor, we will pay any taxes and debts of the deceased. Under the probate code, we have to give creditors a certain amount of time to submit their claims against the estate.

Issues That Can Arise

Occasionally, a devisee (someone who is given something in the will) will contest the will. Someone may claim that the will is not authentic, or was signed under improper influence. If someone contests the will, we will work to protect the estate in the event of probate litigation.
